Please read these Terms & Conditions carefully before using Rocket Fuel. Any reference to You shall mean a General Member or Supporter as appropriate.
By signing up to the Rocket Fuel website or making any transaction with any Rocket Fuel Mission, you are agreeing to the Terms laid out here.
Rocket Fuel is operated by Resound Media, a registered company in England and Wales with registration number #07320697 and registered office Resound Media Ltd, 255 Poulton Rd, Wallasey, CH44 4BT. These Terms & Conditions cover the practice and handling of all data concerning the Rocket Fuel website at rocketfuelhq.com.
Artist — The person or group looking to their fans and further afield to raise funds to help them achieve their Mission
Supporter — an individual who has either signed up to a Subscription to the Artist in return for specified Rewards, purchased any Product from the Artist, or made a One-off Contribution to the Artist.
Subscription —a monthly payment by a Supporter to the Artist to support them in return for Rewards.
General Member — any individual who has registered with Rocket Fuel but is not a Supporter because they have not subscribed to support an Artist. There is no charge to become a General Member
Goals — Goals are creative endeavours (albums, websites, ranges of merchandise etc), promotional activities (tours, publicity campaigns) or operational expenses (computers, vehicles, website creation). Each Goal will have a progress indicator to outline the amount of money banked in relation to the figure needed to fund the completion of this Goal. Any delivery dates and due dates set before Goals are funded should be treated as ideals rather than strict deadlines.
Mission — The Mission is the Artist's commitment to deliver specified Rewards, their attempt to raise funds for advertised Goals and their general endeavour to further their artistic career.
One-Off Contributions — otherwise referred to as donations - a one time individual contribution by an individual or organisation whether Supporter or not to the Artist's Mission. No Rewards will be offered in return for such a contribution.
Rewards — services or items of merchandise which will be delivered to Supporters with a Subscription. Some Rewards will be delivered at regular intervals as stated, some are one-offs and others will be delivered subject to a minimum number of monthly contributions
Products — a physical or digital item of merchandise or service purchased by the Supported. The funds from which go toward the Mission of the Artist
Support — The act of a Supporter giving any funds to the Artist's Mission, be that in the form of a One-off Contribution, Subscription or purchase of a Product from the Artist
Store Mode — In the absence of a live Goal, an Artist's Mission will remain active with the deadline and progress bars disappearing
All information provided by Supporters/General Members/Artists is true and accurate and not misleading
All information and content published on Rocket Fuel is used for the purpose of for which it was provided and it has been obtained lawfully
You agree not to copy or distribute our content or Artist's copyright material and trademarks or any content or trademarks owned by a third party unless you have written permission from Us or the Artist.
1.1. Rocket Fuel is an online platform to enable Artists to raise funds from Supporters. Supporters will be asked to sign up to a Subscription, purchase Products, or make a One-off Contribution to help the Artist attempt their Mission (a collection of Goals).
1.2. We do not necessarily verify the identity of Supporters or individuals who make One-Off Contributions. We do not guarantee that any information provided is accurate.
1.3. The funding progress of each of the Mission's Goals is outlined on our website based on money received by Artist.
1.4. We do not accept any responsibility for the performance of the Artists. If Artists fail to deliver Rewards or Products within 120 days of the advertised delivery, Supporters are advised to terminate any Subscription and inform Rocket Fuel via email (resolution@rocketfuelhq.com). On receipt of this email we will contact the Artist in question and may offer 60 days notice to rectify the issue before considering limiting the Artist's ability to recruit further Supporters and may also inform all of their Supporters of the issues raised.
1.5. These Terms may change upon our giving you notice of 14 days. It is your responsibility to keep up to date with these Terms.
1.6. Supporters/General Members/Artists agree to abide by our Rocket Fuel Rules
2.1. Your personal details and contact information will not be shared with any third parties other than the Artist
2.2. Rocket Fuel and the Artist you support may contact you from time to time with updates.
2.3. Unsubscribing to updates is very simple. For further information, please read our Privacy Policy (rocketfuelhq.com/privacy-policy)
3.1. You are free to access rocketfuelhq.com without creating an account
3.3. Both General Members, Supporters and Artists must notify Rocket Fuel of any change to ensure the information held by Rocket Fuel is accurate
3.4. Rocket Fuel reserves the right to refuse a Subscription to individuals without disclosing a reason.
3.5. When you register with Rocket Fuel you will become a General Member and to do so you will be asked to give the following information:
3.5.1. Full name
3.5.2. Email address
3.5.3. Password
3.5.4. Home phone (optional)
3.5.5. Mobile number (optional)
3.5.6. Delivery address
3.5.7. Agreement to these Terms
3.6. Once the General Member has decided which Artist they would like to support they will select which level of Subscription they wish to sign up to, Product they wish to purchase, or One-off Contribution to give, and will then be asked the following information:
3.6.1. Card number
3.6.2. Expiry Date
3.6.3. CVC Security code
On finalising this process under 3.6 the General Member becomes a Supporter
3.7. Supporters agree to have sufficient funds available to enable the Subscription, One-off Contribution or Product cost to be collected
3.8. Supporters understand that they are only entitled to the specified Rewards and Products outlined for which they have paid. Supporters can track the progress of the funding for each Goal via the Rocket Fuel website.
3.9. If you choose to become a Supporter, you acknowledge that your Support does not entitle you to any rights in or to that Artist or Mission, including without limitation any ownership or control of intellectual property rights in relation to the Artist or Mission.
3.10. Rocket Fuel is a platform where Artists run campaigns to fund their Mission, offering Rewards to Supporters in return for a Subscription as well as the opportunity to Support the Artist. By backing a fundraising campaign you as the Supporter accept that offer made by the Artist and a contract between the Supporter and Artist is formed.
3.11. Rocket Fuel is not a party to the contract between the Supporter and Artist. No refunds shall be issued to Supporters by Rocket Fuel in any circumstances. Refunds if payable will be made by the Artist where appropriate.
3.12. If Supporters are unhappy with the Artist or their performance in relation to their Mission, you should contact the Artist directly.
3.13. A Subscription can be terminated at any time by filling in the cancellation request form at rocketfuelhq.com/cancel-support, and all access to Rewards will cease with immediate effect, although some may still be offered on a goodwill basis only by the Artist or particularly where the Subscription has been far more than 6 months and the termination is not down to anything done or not done by that Supporter
3.14. Please complete the online payment process via https://rocketfuelhq.com/. Payments may be made by all major debit & credit cards.
3.15. We can accept payments in any currency - we'll convert it for you. We currently run missions in the Great British Pound, the US Dollar and the Euro, but anyone from any country can support any Rocket Fuel mission. Payments will be taken in your native currency and automatically converted using the bank's exchange rates.
4.1. Artists offer Rewards in exchange for a Subscription from Supporters
4.2. Rewards have no monetary value and are offered in accordance with applicable legislation
4.3. Supporters may be required to submit additional information in order for Artists to deliver Rewards or Products. Artists or their representation may contact Supporters directly and Supporters should comply with reasonable requests from Artists.
5.1. Rocket Fuel must not be used to promote or create works intended for illegal activities, spreading hatred, threats, encouraging violence or content of an explicit sexual nature.
5.2. The Artist agrees to use all funding raised for his/her Mission only in respect of the Mission and that such funding will not be used for any other purpose
5.3. Artists should make every effort to deliver promised Rewards or Products and respond to enquiries from Supporters. Artists understand that Rocket Fuel reserves the right to close down a Goal at any time and has no right to seek compensation or pursue Rocket Fuel for any damages if the event of a closed down Goal, Mission or loss of data. Artists should keep records of their contacts which they may use for legitimate reasons in line with current data protection regulations.
5.4. Artists retain all rights of ownership (including intellectual property rights) in the content that they post onto Rocket Fuel, and in relation to their name, recordings (in any format) or any other material produced by them.
5.5. By sharing content on Rocket Fuel the Artist warrants that:
5.5.1. They have not used any materials within their Mission pitch that infringes on copyright or a third party's intellectual property.
5.5.2. They are entitled to use all images, music, text and video that appear within their pitch.
5.6. Rocket Fuel reserves the right to edit or remove content which has been flagged as inappropriate or infringing upon copyright. Any material deemed as racist, offensive, explicitly sexual or inappropriate shall be removed.
6.1. Rocket Fuel fees are deducted from the amounts contributed by Supporters and received by our payment provider account set up for this purpose. Artists receive their portions of the fees (the remainder) directly from Stripe, our payment processor. .
6.2. As a Supporter, you will not be charged any additional fees and only pay the figure that you agreed to under your Subscription, One Off Contribution or Product purchase
Rocket Fuel fees for Artists are:
6.2.1. A fee of 2.4% plus 20p per successful charge taken by our payment provider. This amount is subject to change and out of our control however we are committed to using a competitive service provider.
6.2.3. Artists can set up a mission on Rocket Fuel free of charge. Artists may however opt to pay for a support package. Prices are clearly indicated via the website and artists are under no obligation to pay for a package.
6.2.4. The commission charged by us on the funds an Artist raises via all Support from the Supporter is 10% as standard.
6.2.5 For Artists raising funds for services with Resound Media and affiliated partners, all funds may be directed to Rocket Fuel for the assigned goal. For any part-funded Goals, Resound Media and affiliated partners will deliver a portion of the agreed service. The level of service is at the discretion of the service provider.
7.1. Nothing in these Terms will restrict our liability for death or personal injury resulting from our negligence, or for any other liability that cannot be limited or excluded by law.
7.2. Rocket Fuel will not be liable for any claims, damages or demands arising from disputes with Supporters and Artists.
7.3. Rocket Fuel will perform with reasonable skill and care and will use reasonable endeavours to address issues that arise, of which we are reasonably aware
7.4. Rocket Fuel are not responsible for any websites linked to from Artist's pages. Entering other linked sites is done at your own risk.
7.5. Rocket Fuel cannot make assurances about the availability of our website or any services made available through it and disclaim all liability associated with any technical issues that may arise.
7.6. Rocket Fuel will not be responsible for any loss incurred by you as a result of you breaching these Terms.
7.7. Rocket Fuel shall not be liable to you as a result of any delay or failure to perform its obligations as a result of a Force Majeure Event. Force Majeure Event means an event beyond the reasonable control of Rocket Fuel including but not limited to strikes, lock-outs or other industrial disputes (whether involving the workforce of the party or any other party), failure of a utility service or transport network, act of God, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm or default of suppliers or subcontractors.
7.8. Rocket Fuel shall under no circumstances whatever be liable to Supporters/General Members/Artists, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profit, or any indirect or consequential loss arising under or in connection with our obligations under these Terms.
7.9. Rocket Fuel's total liability in respect of all other losses arising, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed £100.
7.10. Rocket Fuel cannot make assurances regarding the performance of our online payment provider.
8.1. You and the Artist agree to use Rocket Fuel in accordance with these Terms. You and the Artist agree that you will compensate Rocket Fuel (and our employees, suppliers and agents) absolutely for any losses, damages, costs and expenses, including reasonable legal fees we incur that arise out of:
8.2. any breach by you or the Artist of these Terms;
8.3. any liability we incur as a result of your or the Artist's use of our website.
9.1. Other than set out in these Terms, a person who is not a party to the agreement shall not have any rights under or in connection with it.
10.1. If a court or any other competent authority finds that any provision of these Terms (or part of any clause) is invalid, illegal or unenforceable, that clause or part-clause shall, to the extent required, be deemed deleted, and the validity and enforceability of the other clauses shall not be affected
10.2. If any invalid, unenforceable or illegal clause of the Terms would be valid, enforceable and legal if some part of it were deleted, the clause shall apply with the minimum modification necessary to make it legal, valid and enforceable.
11.1. The exclusive jurisdiction for any dispute arising out of these Terms will be dealt with in England and Wales under English law.
12.1. We store and process your data based on the contract formed when you make your booking, and in line with the General Data Protection Rules (2018).
12.2. We securely process and store data in order to enable us to process your payment, fulfill the services we offer, send you your confirmation details, and help us to contact you urgently if there are any problems. We also use your details to enable website functionality including payment history and General Member area logins.
12.3. We retain your data only as long as is necessary to provide the aforementioned service and functionality. We will remove or redact personal data if you request erasure of your data, as is your right, by contacting us on hey@rocketfuelhq.com.
